  • Correction of incorrect personal data,

  • Restriction of data processing, in case we are not allowed to delete your data due to legal obligations,
  • Objection to the processing of your data with us and
  • Data portability, if you have consented to the data processing or have concluded a contract with us.

If you have given us your consent, you can withdraw it at any time.

You can always contact the supervisory authority responsible for you with a complaint. Your competent authority will be based on your place of residence, work or alleged infringement.

Purposes of data processing by Xoyondo and third parties

We process your personal data only for the purposes stated in this privacy policy. A transfer of your personal data to third parties for purposes other than those mentioned does not take place. We only share your personal information with third parties if:

  • You have given your explicit consent,
  • the processing is required to complete a contract with you,
  • the processing is necessary to fulfill a legal obligation,
  • the processing is necessary to protect legitimate interests and there is no reason to believe that you have an overriding legitimate interest in not disclosing your information.

Deletion of data

We adhere to the principles of data avoidance and data minimization. Therefore, we only store your personal data for as long as necessary in order to provide our services. After discontinuation of the respective purpose, the corresponding data will be regularly deleted in accordance with the statutory provisions.

Collection of general information when visiting our website

When you access our website, a cookie automatically records information of a general nature. This information (server log files) includes, for example, the type of web browser, the operating system used, the domain name of your Internet service provider and the like. This is only information that does not allow conclusions about your person.

This information is technically necessary to correctly deliver the contents of web pages requested by you and is mandatory when using the internet.

Anonymous information of this kind is statistically evaluated by us, in order to optimize our appearance and the technology behind it.

Collection of personal information when visiting our website

You can visit our website without providing personal information. If personal data (such as your name or e-mail address) is collected on our pages, this is done as far as possible on a voluntary basis. We collect, process and use personal data only so that we can offer you our services. All personal data will only be stored as long as this is necessary for the stated purpose (Duration of a poll or message board).

The processing of your personal data is based on our legitimate interest for the aforementioned purposes. We do not use your information to draw conclusions about you.

How we use your data

The information you provide (e.g., names, e-mail addresses) will be stored in our databases for the duration of the poll or the message board you create on Xoyondo so that we can make the poll website available to you and your participants. If the poll or message board is deleted, all the information you provided are removed from the database. If the poll administrator invites participants through Xoyondo, the specified email addresses will be stored for the duration of the poll. These email addresses are only accessible via the administration area of the poll.

In order to send notifications to the email address you have provided, we use the external email service Mailgun. For this purpose, your email address will be transmitted to Mailgun. Mailgun will store the address temporarily (up to 30 days) and will only use it for the purpose of delivering messages generated by the use of Xoyondo. Mailgun is committed to privacy to the same extent as we, which has been secured by a contract between Mailgun and Xoyondo. When creating a poll, you have the option to import your Google or Yahoo address books to make it easier to invite participants to your poll. During the import process, we never have access to your Google / Yahoo password. In addition, your Google / Yahoo address book will not be stored on our servers. We only save the email addresses of the participants who you invite to your poll. All email addresses will be deleted as soon as you delete your poll via the administration area.

How we protect your data

Xoyondo implements several mechanisms to prevent the unauthorized access to polls and accounts.

A poll can only be accessed using a unique link that is created by Xoyondo and distributed by the administrator (himself or via Xoyondo). This link contains a 15 digit random code that identifies the poll and prevents unauthorized access due to the complexity of the code.

User accounts are protected by passwords. Passwords are only stored in encrypted form on our servers. We check the strengh of your password during the sign-up process in order to ensure that your password is sufficiently complex. This increases the security of your account.

All of your data is stored on modern webservers with the highest security standards. See "Location of the data" for more details.

To protect the security of your data during transmission, we use state-of-the-art encryption (SSL) technology over HTTPS.

Cookies

Like many other websites, we also use so-called "cookies". Cookies are small text files that are transferred from a website server to your hard drive. This automatically gives us certain data, such as IP address, browser used, operating system and your connection to the Internet.

Xoyondo uses cookies to make the use of the service easier for you and to record statistical information.

Internet browsers typically accept cookies. In general, you can disable the use of cookies at any time through the settings of your browser. You can also view our website without cookies. Please note that some features of our website may not work in this case.

Registration on our website

You can register on Xoyondo and create an account. For this we need your name and your e-mail address. You have the opportunity to change this information at any time. Deleting the account will remove your information from our database. When you register on Xoyondo, you agree that we will send you important information regarding the service (such as changes in the offer or technical conditions). Your email address will not be used for marketing purposes.

Provision of paid services

To provide paid services we may ask for additional data, such as your address, to execute your order. We store this data in our systems until the legal retention periods have expired. For payment processing we use the service Braintree, which belongs to Paypal. Sensitive data (such as credit card details or Paypal access data) arising from an order will never be processed or cached on our servers. The processing takes place completely via Braintree. Voting and commenting function

When users participate in polls on our website or leave comments, we store the corresponding timestamps as well as the name that was provided by the participant. This is done for security purposes, as we may be prosecuted for any illegal content on our website, even if it has been created by users.

Email notifications

Based on your consent, we will send you notifications of new comments or vote in a poll to your specified email address. For this we use the external email service Mailgun (details can be found above).

In order to send out email notifications we need a valid e-mail address. In order to verify that notifications were requested by the actual owner of an e-mail address, we use the "Double opt-in" procedure. For this purpose we log the request of the notifications, the dispatch of a confirmation email and the receipt of the requested answer. Further data is not collected. The data will be used exclusively for the notification dispatch.

You may revoke your consent to the storage of your personal data and its use for the notification feature at any time. In each notification email there is a corresponding unsubscribe link.

Contact form

If you contact us via email or our contact form, you give us your consent that we contact you for this purpose. This requires the specification of a valid e-mail address. The information you provide will be stored for the purpose of processing the request and for possible follow-up questions. After completing the request we will automatically delete your personal data.

Use of Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (following: Google). Google Analytics uses Cookies, i.e. text files that are stored on your computer and that allow an analysis of the use of the website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. However, due to the activation of IP anonymization on Xoyondo, your IP address will be shortened beforehand by Google within member states of the European Union. Only in exceptional cases the full IP address will be sent to a Google server in the US and shortened there. On behalf of Xoyondo, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to Xoyondo. The IP address provided by Google Analytics as part of Google Analytics will not be merged with other Google data.

The purposes of the data processing are the evaluation of the use of the website and the compilation of reports on activities on the website. The processing is based on the legitimate interest of Xoyondo.

You can prevent the storage of cookies by a corresponding setting of your browser software; please note that if you do this, you may not be able to use all the features of this website to the fullest extent possible. In addition, you may prevent the data collection by Google generated by the cookie (including your IP address) as well as the processing of this data by Google by downloading the browser plug-in available under the following link: Browser Add On to disable Google Analytics.

In addition or as an alternative to the browser add-on, you can prevent Google Analytics tracking on our pages by clicking this link. An opt-out cookie will be installed on your device. This will prevent the data collection by Google Analytics for this website and for this browser in the future, as long as the cookie remains installed in your browser.

The statistical data generated by your visit is stored by Google for a maximum of 26 months and is then deleted.

Use of script libraries (Google Webfonts)

In order to render our content correctly and graphically appealing across browsers, we use script libraries and font libraries on this website, such as: Google webfonts (https://www.google.com/webfonts/). Google web fonts are transferred to the cache of your browser to prevent multiple loading. If the browser does not support Google Web fonts or prohibits access, content will be displayed in a standard font.

The call of script libraries or font libraries automatically triggers a connection to the operator of the library. It is theoretically possible that operators of such libraries collect data.

Online advertising with third parties

Xoyondo displays advertising on some of the web pages. We display ads from Google's and other ad networks. They can be targeted based on the poll content. You can review Google’s Ads Privacy Policy here: http://www.google.com/policies/privacy/ads/ . Furthermore, you can use Google’s Ads Preferences Manager to configure the right ads settings for you. We are only displaying non-personalized ads for visitors from the EU, if they do not actively consent to the corresponding use of cookies.

Change of our privacy policy

We reserve the right to amend this privacy policy to always comply with the latest legal requirements or to implement changes to our services in the privacy policy, e.g. when introducing new services. Your new visit will be subject to the new privacy policy.
